Liability Waiver & Assumption of Risk
Please read this waiver carefully before participating in any ARKofUSA camp, training session, or event. By registering, you acknowledge and accept the inherent risks of athletic activities.
IMPORTANT: This document is a legal waiver and release of liability. By registering for and participating in any ARKofUSA camp or event, you agree to the terms below. For participants under the age of 18, a parent or legal guardian must read, understand, and agree to this waiver on behalf of the minor.
1. Acknowledgment of Inherent Risks
Basketball and athletic training activities involve inherent risks of physical injury. By participating in ARKofUSA camps, events, and training sessions (collectively, "Activities"), you acknowledge that these Activities carry risks that cannot be fully eliminated, regardless of the care taken to avoid injury.
These inherent risks include, but are not limited to:
- Sprains, strains, and muscle injuries
- Fractures, dislocations, and broken bones
- Concussions and other head injuries
- Overexertion, heat exhaustion, and dehydration
- Ligament tears (including ACL, MCL, and other joint injuries)
- Bruises, cuts, and abrasions
- Dental injuries
- Cardiac events
- Injuries resulting from contact with other participants, equipment, or facilities
- In rare cases, severe or life-threatening injuries including paralysis or death
2. Voluntary Assumption of Risk
By registering for and participating in any Activity, you voluntarily assume all risks associated with participation, whether known or unknown, foreseen or unforeseen. You understand that participation is entirely voluntary and that you may withdraw at any time.
3. Release and Waiver of Liability
In consideration of being allowed to participate in Activities, you hereby release, waive, discharge, and agree not to sue the following parties (collectively, the "Released Parties"):
- ARKofUSA Inc, its parent companies, subsidiaries, and affiliates
- Officers, directors, and shareholders
- Coaches, trainers, and instructors
- Employees, staff, and contractors
- Volunteers and event organizers
- Venue owners and operators
from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, illness, damage, or loss (including death) sustained by the participant during or as a result of participation in any Activity, whether caused by the negligence of the Released Parties or otherwise.
4. Medical Emergency Authorization
In the event of a medical emergency during an Activity, if a parent, guardian, or designated emergency contact cannot be reached in a timely manner, you authorize ARKofUSA and its coaches, staff, and representatives to seek and consent to emergency medical treatment for the participant, including but not limited to first aid, CPR, transportation by ambulance, and treatment at a medical facility.
You understand that the cost of any emergency medical treatment is the responsibility of the participant and/or their parent or guardian, not ARKofUSA.
5. Health Representation
By registering for an Activity, you represent and warrant that:
- The participant is in good physical health and has no medical conditions, injuries, or disabilities that would prevent safe participation, OR has disclosed any such conditions to ARKofUSA in writing prior to the Activity.
- The participant has not been advised by a medical professional to avoid strenuous physical activity.
- You will promptly inform ARKofUSA coaches or staff of any changes in the participant's health status before or during an Activity.
ARKofUSA reserves the right to exclude any participant from an Activity if, in our reasonable judgment, continued participation poses a risk to the participant's health or the safety of others.
6. Insurance
ARKofUSA strongly recommends that all participants maintain their own health insurance that provides adequate coverage for injuries sustained during athletic activities. ARKofUSA does not provide health or accident insurance for participants.
You acknowledge that you are responsible for any medical expenses resulting from injuries sustained during an Activity, and you agree not to hold ARKofUSA or the Released Parties responsible for such costs.
7. Minors — Parent/Guardian Assumption of Risk
For participants under the age of 18: By registering a minor for any Activity, the parent or legal guardian acknowledges and accepts the inherent risks described in this waiver on behalf of the minor. The parent or guardian agrees to the release and waiver of liability set forth herein, both for themselves and on behalf of the minor participant.
The parent or guardian further represents that they have the legal authority to enter into this agreement on behalf of the minor.
8. Indemnification
You agree to indemnify, defend, and hold harmless ARKofUSA Inc, its officers, directors, employees, coaches, volunteers, and agents (the Released Parties) from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) brought by you, the participant, or any third party arising out of or related to:
- Participation in any Activity
- Any breach of the representations made in this waiver
- Any negligent or wrongful act or omission by the participant
9. Severability
If any provision of this waiver is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
10. Governing Law
This Liability Waiver and Assumption of Risk shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under or in connection with this waiver shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Nevada.
11. Acknowledgment
By registering for any ARKofUSA camp, event, or training session, you acknowledge that:
- You have read this Liability Waiver and Assumption of Risk in its entirety.
- You understand the inherent risks involved in athletic activities.
- You voluntarily agree to assume those risks.
- You waive your right to bring legal claims against the Released Parties as described herein.
- You are signing this waiver freely and voluntarily, without inducement.
