Photo & Video Release

By registering for and participating in ARKofUSA camps and events, you consent to the capture and use of photographs, video, and audio recordings as described below.

1. Consent to Record

By registering for and attending any ARKofUSA camp, event, training session, or related activity (collectively, "Events"), you consent to being photographed, filmed, and audio recorded by ARKofUSA Inc, its employees, contractors, and authorized representatives during the course of the Event.

This consent includes, but is not limited to:

  • Still photographs
  • Video recordings
  • Audio recordings
  • Live streams and broadcasts
  • Drone or aerial footage captured at Event venues

2. Grant of Rights

You hereby grant ARKofUSA Inc a worldwide, perpetual, irrevocable, royalty-free, fully transferable, and sublicensable license to use, reproduce, distribute, display, and create derivative works from any photographs, video, audio, or other recordings that include your likeness, image, voice, or name (collectively, "Content") for any purpose related to ARKofUSA's business, including but not limited to:

  • Marketing and advertising: Print materials, digital advertising, flyers, banners, and billboards.
  • Social media: Posts, stories, reels, and ads on platforms including Instagram, Facebook, Twitter/X, TikTok, YouTube, and any future platforms.
  • Website: Use on the ARKofUSA website and any affiliated websites.
  • Promotional materials: Camp brochures, email newsletters, sponsorship decks, and press kits.
  • Press and media: Sharing with news outlets, journalists, and media partners for editorial coverage of ARKofUSA events.
  • Internal use: Training materials, coaching resources, and internal presentations.

3. No Compensation

You acknowledge and agree that you will receive no payment, royalty, or other compensation for the use of your likeness, image, voice, or name in Content created at ARKofUSA Events. This applies regardless of the manner, frequency, or duration of use.

4. Right to Edit and Modify

ARKofUSA reserves the right to edit, crop, composite, digitally alter, enhance, or otherwise modify any Content in which you appear. This includes combining Content with other images, text, graphics, music, or narration for creative or promotional purposes.

ARKofUSA will not intentionally use Content in a manner that is defamatory, obscene, or disparaging to the participant.

5. Minors — Parent/Guardian Consent

For participants under the age of 18: By registering a minor for any ARKofUSA Event, the parent or legal guardian provides consent on behalf of the minor for the capture and use of Content as described in this Photo & Video Release.

The parent or guardian represents that they have the legal authority to grant this consent on behalf of the minor.

6. Right to Revoke

You may request that ARKofUSA remove specific Content in which you appear from future use. To make this request, send an email to arkos-2@polsia.app with the following information:

  • Your name (or the name of the minor participant)
  • Description of the specific Content you want removed
  • Links to the Content, if available
  • The Event at which the Content was captured

ARKofUSA will make reasonable efforts to honor removal requests for Content under our direct control. However, please be aware of the following limitations:

  • Previously published materials: Content that has already been published in print materials, distributed to media outlets, or shared on third-party platforms may not be fully retrievable or removable.
  • Third-party use: Once Content has been shared with or reposted by third parties (including media outlets and social media users), ARKofUSA cannot guarantee removal from those third-party platforms.
  • Cached and archived content: Web caches, search engine indexes, and internet archives may retain previously published Content beyond our control.

We will respond to removal requests within 30 days and will remove Content from all channels under our direct control where reasonably practicable.

7. No Obligation to Use

ARKofUSA is under no obligation to use any Content in which you appear. The rights granted herein are permissive, not obligatory.

8. Governing Law

This Photo & Video Release shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under or in connection with this release shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Nevada.

9. Acknowledgment

By registering for any ARKofUSA Event, you acknowledge that:

  • You have read and understand this Photo & Video Release.
  • You voluntarily consent to being photographed, filmed, and recorded.
  • You grant ARKofUSA the rights described herein to use Content in which you appear.
  • You understand that no compensation will be provided for the use of your likeness.
  • For participants under 18, the parent or guardian provides this consent on the minor's behalf.
